Conditions of Agreement
1. All the terms of this Agreement between the Company and the Purchaser
are contained in this document and no statement, representation or description,
whether made by the Company or its servants or agents on its behalf, whether
written or oral, or contained in any advertising literature or other matter issued
by or on behalf of the Company, shall form part of this Agreement or have any
effect thereon, or be deemed to be a representation, warranty or condition inducing
of forming part thereof.
2. The Company will use its best endeavours to meet the dates of delivery
specified but failure to do so shall not entitle the Purchaser to cancel or recind
this Agreement.
3. The Company reserves the right to effect minor changes to the specifications
when certain materials are not available and such minor changes shall not be
entitle the Purchaser to rescind or cancel this Agreement.
4. Any variation, alteration or addition to the work agreed to be done will
be undertaken by the Company only when agreed in writing and the purchaser shall
be bound to pay the proper charge therefor.
The Company cannot guarantee that there will be no cable or pipe work visible.
The Company will use its best endeavours to hide the cable or pipe work wherever
possible.
5. Guarantee: All equipment and labour are guaranteed for a period of one
year. In the case of misuse THE CLADDING CENTRE reserves the right to charge.
All white uPVC products used on your property have a manufacturers guarantee
of 10 years including colour stability.
6. If Financial Loan Facilities are required the Company will assist in obtaining
such facilities but in the event of such facilities being unobtainable, the Company
undertakes not to enforce its rights under the agreement and to refund any deposit
paid by the Purchaser providing that no work described in this agreement has
been started and that no goods described in this agreement have been supplied
and that the customer has co-operated fully with the Finance Company or’an
alternative Finance Company in supplying all information requested or required
by them.
7. Goods fitted by the Company remain the property of the Company (in part
or in whole) until the contractural price is received in full.
8. The deposit is not refundable except as determined by clause 6 of these
Conditions of Agreement.
9. TheCompany reserves the rightto withdrawfrom the Contract in whole or
in part if close examination of the structure by representatives or fitters on
the Company sent to examine the structure or perform the work shows, in. their
opinion, that the structure is unsuitable for installation by the Companys techniques
or that safe access to any part of the structure is not possible using the equipment
normally employed, and in such event the deposit paid by the Purchaser shall
be returnable.
10. The Purchaser agrees to permit access to the installation address to
the Company, its servants and workmen at reasonable times so that the Company
may complete the installation.
11. The Company will not be liable for any loss or consequential liability
or damage sustained by,the Purchaser by reason of Act of God, war, riot, fire,
strike, lockout. government control or regulation abnormal weather conditions,
accident, breakdown or any other circumstances beyond the Companys control.
12. Our unique secret fixed honeycombed uPVC fascias and sothts are designed
to fit directly over existing timberwork. We do not remove the existing timberwork.
If there are any isolated areas of rotten timberwork we replace in tanalised
timber.
13. Should any defective timberwork bd discovered in the roof or roof joists
the Company reserves the right to levy an additional charge.
14. The colour fastness or brown uPVC when selected can not be guaranteed.
It does not hold its colourfastness like white and will discolour.
NONE OF THE ABOVE TERMS ARE INTENDED TO TAKE AWAY, OR AFFECT IN ANY WAY THE
STATUTORY RIGHTS OF THE PURCHASER AS A CONSUMER. |
